1. Information on how to enter form part of the terms and conditions of entry. All entries are via www.ten.com.au/videohits as advertised on the the Video Hits website and or in program within Video Hits on  Network TEN. In order to qualify to submit an entry, viewers must be registered member of the website. It is free to become a member. These terms and conditions apply in conjunction with the TEN website membership rules.

2. To submit an entry members will be required to visit the competiton page on the Video Hits website and submit their top 5 music video clip selection. Incomplete or incomprehensible entries will be ineligible.

3. This promotion is a game of skill and chance plays no part in determining the prize winner.

4. Entry is open to all permanent residents of Australia. Cost of entry via the internet is free. Internet connection rates apply.
 
5. The competition entry period commences on Saturday 16 February 2008 at 00:01 EST and concludes on Sunday 20 December 2008 @ 23:59.

6. The winner/s will be judged throughout the competition entry period each Monday at 12:00am  at  EST at the premises of the promoter. The ' best' top 5 submission as determined by the producers of Video Hits First will be played in full in Video Hits First and deemed the ' winner'.  Judges/Promoters decision is final and no correspondence will be entered into.  Prizes cannot be transferred, exchanged or redeemed for cash.

7. The producers will select the winners based on the entrants top 5 selection. Video Clips classification and suitability will all be taken into consideration when selecting the winner.  The producers decision is absolutely final and no correspondence will be entered into.

8. Winners will be selected weekly unless the producers open the invitiation for ' My Top 5' to guest and /or hosts appearing on the show. In the event that the hosts and/or guests ' Top 5' is played the entries for that week will carry over to the following week.

9. Prizes and values are as follows:

• Their top 5 clip choice played in full in Video Hits First – money can't buy
• Name credit on Video Hits First when their top 5 video clips are played – money can't buy
• 1x Rexona Girl pack valued at $50
• Total value is $50 PLUS money can't buy guest DJ experience.

10. The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

11. Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
 
12. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.  It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

13. It is a condition of entering this competition that the entrant agrees for their image, name and/or footage to appear either on the Video Hits website, and or in the Video Hits program in conjunction with this promotion. The winner agrees to the use of their name, image, vision and photograph/s for publicity and promotional purposes, without compensation. The entrant agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s
 
14. If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
 
15. Employees and their immediate families of Network TEN and all agencies and companies associated with the promotion are ineligible to enter.
 
16. The winners will be notified by mail and published on the Video Hits website.

17. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing.  All prize values are in Australian dollars unless where stipulated. The Promoter takes no responsibility for any variation in prize values. The Promoter accepts no responsibility for any variation in the prize value. All prize values are in Australian dollars.

18. If for any reason any element of the prize/s becomes unavailable for any reason, which is out of the promoters control then a similar prize to equal value, will be awarded in lieu.

19. Network TEN  and all associated agencies will not be held liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s, except for any liability which cannot be excluded by law. It is a condition of accepting the prize that the winner must sign a legal disclaimer to indemnify the promoter .

20. All entries become the property of the Promoter and will be used solely for the purpose of conducting this promotion.  All personal details of winning entrants will be stored electronically at the office of the Promoter or its agency acting on its behalf in relation to this promotion.  A request to access, update or correct any information should be directed to the Promoter. A copy of the Promoter’s privacy policy in relation to treatment of personal information collected may be obtained by contacting the Promoter.

21. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
